中國(guó)和東盟國(guó)家外長(zhǎng)發(fā)表關(guān)于全面有效落實(shí)《南海各方行為宣言》的聯(lián)合聲明(附英文文本)

海峽飛虹消息(駐萬象記者蒙龍):中國(guó)外長(zhǎng)王毅和東盟國(guó)家外長(zhǎng)7月25日在老撾萬象舉行會(huì)晤,會(huì)后發(fā)表了“中國(guó)和東盟國(guó)家外交部長(zhǎng)關(guān)于全面有效落實(shí)《南海各方行為宣言》的聯(lián)合聲明”,強(qiáng)調(diào)維護(hù)南海的和平與穩(wěn)定符合中國(guó)與東盟國(guó)家以及國(guó)際社會(huì)的基本利益,強(qiáng)調(diào)由直接有關(guān)的主權(quán)國(guó)家通過友好磋商和談判,以和平方式解決領(lǐng)土和管轄權(quán)爭(zhēng)議。

 

聯(lián)合聲明說,我們認(rèn)識(shí)到維護(hù)南海的和平與穩(wěn)定符合中國(guó)與東盟國(guó)家以及國(guó)際社會(huì)的基本利益;重申2002年《南海各方行為宣言》是具有里程碑意義,展現(xiàn)了各方依據(jù)《聯(lián)合國(guó)憲章》以及包括1982年《聯(lián)合國(guó)海洋法公約》在內(nèi)的公認(rèn)國(guó)際法原則,共同維護(hù)地區(qū)和平穩(wěn)定、增進(jìn)互信和信心的共同承諾;重申《宣言》在維護(hù)地區(qū)和平穩(wěn)定中發(fā)揮的重要作用;承諾全面有效完整落實(shí)《宣言》,并在協(xié)商一致的基礎(chǔ)上實(shí)質(zhì)性推動(dòng)早日達(dá)成“南海行為準(zhǔn)則”;憶及2012年第15屆中國(guó)東盟峰會(huì)關(guān)于《宣言》十周年紀(jì)念的聯(lián)合聲明;鑒此,謹(jǐn)作出如下聲明:

 

一、各方重申尊重并承諾,包括1982年《聯(lián)合國(guó)海洋法公約》在內(nèi)的公認(rèn)的國(guó)際法原則所規(guī)定的在南海的航行及飛越自由。

 

二、有關(guān)各方承諾根據(jù)公認(rèn)的國(guó)際法原則,包括1982年《聯(lián)合國(guó)海洋法公約》,由直接有關(guān)的主權(quán)國(guó)家通過友好磋商和談判,以和平方式解決它們的領(lǐng)土和管轄權(quán)爭(zhēng)議,而不訴諸武力或以武力相威脅。

 

三、各方承諾保持自我克制,不采取使?fàn)幾h復(fù)雜化、擴(kuò)大化和影響和平與穩(wěn)定的行動(dòng),包括不在現(xiàn)無人居住的島、礁、灘、沙或其它自然構(gòu)造上采取居住的行動(dòng),并以建設(shè)性的方式處理它們的分歧。

 

四、各方可在包括航行安全、搜救、海洋科研、環(huán)境保護(hù)以及打擊海上跨國(guó)犯罪等各領(lǐng)域探討或開展合作。

 

五、各方鼓勵(lì)其他國(guó)家尊重《宣言》所包含的原則。

 

六、有關(guān)各方重申制定“南海行為準(zhǔn)則”將進(jìn)一步促進(jìn)本地區(qū)和平與穩(wěn)定,并同意在各方協(xié)商一致的基礎(chǔ)上,朝最終達(dá)成該目標(biāo)而努力。

Joint Statement of the Foreign Ministers of ASEAN Member States and China on the Full and Effective Implementation of the Declaration on the Conduct OF PARTIES IN the SOUTH CHINA SEA 

 

We, the Foreign Ministers of ASEAN Member States and the People’s Republic of China met in Vientiane, Lao People’s Democratic Republic, on 25 July 2016.

 

RECOGNISING that maintaining peace and stability inthe South China Sea region serves the fundamental interests of ASEAN Member States and China (“the Parties”) as well as the international community;

 

REAFFIRMING that the Declaration on the Conduct of Parties in the South China Sea (DOC) is a milestone document that embodies the collective commitment of the Parties to promote peace, stability, mutual trust and confidencein the region,in accordance with the UN Charter and universally recognized principles of international law, including the 1982 United Nations Convention on the Law of the Sea (UNCLOS);

 

REAFFIRMING the importance and role of the DOC in maintaining peace and stability in the region;

 

COMMITTED to the full and effective implementation of the DOC in its entirety and working substantively towards the early adoptionof a Code of Conduct in the South China Sea (COC)based on consensus;

 

RECALLING the Joint Statement of the 15th ASEAN-China Summit on the 10th Anniversary of the DOC adoptedin 2012;

 

HEREBYstate the following:

 

1. The Parties reaffirm their respect for and commitment to the freedom of navigation in and overflight above the South China Seaas provided for bythe universally recognised principles of international law, including the 1982 UNCLOS.

 

2. The Parties concerned undertake to resolve their territorial and jurisdictional disputes by peaceful means,without resorting to the threat or use of force, through friendly consultations and negotiations by sovereign states directly concerned, in accordance with universally recognised principles of international law, including the 1982 UNCLOS;

 

3. ThePartiesundertake to exercise self-restraint in the conduct of activities that would complicate or escalate disputes and affect peace and stability including, among others, refraining from action of inhabiting on the presently uninhabited islands, reefs, shoals, cays, and other features and to handle their differences in a constructive manner.

 

4. The Partiesmay explore or undertake cooperative activities,in fields such as navigation safety, search and rescue, marine scientific research, environmental protection, and combatingtransnational crimes at sea.

 

5. The Parties encourage other countries to respect the principles contained in the DOC.

 

6. The Parties concerned reaffirm that the adoption of a code of conduct in the South China Sea would further promote peace and stability in the region and agree to work, on the basis of consensus, towards the eventual attainment of this objective.
